Terms of Use

1. Introduction 

These Terms of Use ("Terms") govern your access to and use of the digital platforms operated by Think:Kids ("Think:Kids," "we," "our," or "us"), including but not limited to our Learning Management Systems (LMS), event registration systems, and membership community platform (collectively, the "Platforms"). By accessing or using any Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as the Think:Kids Privacy Policy, available at https://thinkkids.org/privacy-policy/. If you do not agree to these Terms, you may not access or use the Platforms. 

2. Eligibility and Account Responsibilities 

2.1 Eligibility Requirements 

Access to certain Platforms or features may be limited to individuals who have completed specific training or certification programs (such as the Certification in Collaborative Problem Solving course). Eligibility requirements will be communicated at the time of registration. 

2.2 Account Information 

You agree to provide accurate, current, and complete information when creating an account and to maintain and promptly update such information as necessary. 

2.3 Account Security 

You are responsible for safeguarding your login credentials and for all activities conducted under your account. You agree to notify Think:Kids promptly of any unauthorized access or suspected security breach. 

3. Acceptable Use 

You agree to use the Platforms in a lawful, respectful, and responsible manner and in accordance with all applicable laws, policies, and community standards. You may not: 

  • Harass, threaten, discriminate against, or otherwise harm other users. 
  • Post, upload, or transmit unlawful, defamatory, infringing, or otherwise objectionable content. 
  • Share personal, confidential, or sensitive information of others without proper authorization. 
  • Impersonate any individual or entity or misrepresent your affiliation with any person or organization. 
  • Interfere with or disrupt the operation, security, or integrity of the Platforms. 
  • Upload or transmit (or attempt to upload or transmit) any material that acts as a passive or active information collection or transmission mechanism (sometimes referred to as “spyware” or “passive collection mechanism”).  
  • Attempt to reverse engineer, decompile, or otherwise misuse Platform software or systems. 
  • Copy, reproduce, distribute, or publicly display Platform content except as expressly permitted. 
  • Use the Platforms in connection with any commercial endeavors except those that are specifically endorsed or approved by Think:Kids. 

Think:Kids reserves the right to remove content, restrict access, or take other appropriate action in response to violations of these Terms. 

4. User-Generated Content 

The Platforms may invite you to chat, contribute to, or participate in blogs, message boards, online forums, and other functionality, and may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and material to us or on the Platforms, including but not limited to text, writings, video, audio, photographs, graphics, comments, suggestions, or personal information or other material (collectively, “User Content”).  

4.1 Ownership 

You retain ownership of any User Content you submit, post, or upload to the Platforms. 

4.2 License to Think:Kids 

By submitting User Content, you grant Think:Kids a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute such content within the Platforms for educational, community, and operational purposes. 

4.3 Responsibility for Content 

You represent and warrant that you have all necessary rights and permissions to submit User Content and that such content does not infringe or violate the rights of any third party. 

User Content may, in some instances, be viewable by other users of the Platforms. When you create or make available any User Content that can be viewed by other users, you thereby represent and warrant that: 

  • Your User Content is not false, inaccurate, or misleading. 
  • Your User Content does not contain unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation.  
  • Your User Content is not obscene, lewd, lascivious, violent, harassing, libelous, slanderous, or otherwise objectionable (as determined by us).  
  • Your User Content does not ridicule, mock, disparage, intimidate, or abuse anyone. 
  • Your User Content does not include any offensive comments that are connected to race, national origin, gender, sexual preference, or physical handicap.  
  • Your User Content does not violate any applicable law, regulation, or rule.  

Although we have no obligation to monitor User Content, Think:Kids reserves the right to remove or edit User Content without notice, restrict access, or take other appropriate action in response to violations of these Terms. 

5. Privacy and Data Practices 

Your use of the Platforms is subject to the Think:Kids Privacy Policy, which describes: (a) the categories of personal data we collect; (b) how we use, store, and share such data; and (c) your rights and choices regarding your information. Think:Kids does not sell, rent, or share personal data outside the organization except as necessary to provide services, support Platform operations, or comply with legal obligations. By using the Platforms, you consent to the data practices described in the Privacy Policy. 

6. Intellectual Property 

All content, materials, and features made available by Think:Kids on the Platforms—including text, graphics, logos, videos, course materials, and other resources—are owned by or licensed to Think:Kids and are protected by applicable intellectual property laws. You may use Platform content solely for your personal or professional development. You may not copy, modify, distribute, or publicly display any content without prior written authorization. If you are a member of the Collaborative Problem Solving Certified Community, refer to your individual certification license agreement for additional terms related to content use.  

7. Educational and Professional Disclaimers 

The Platforms are intended for educational and professional development purposes. Think:Kids does not provide medical, psychological, or clinical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any health-related questions you may have.

8. Confidentiality and Professional Conduct 

Certain interactions on the Platforms may involve the exchange of sensitive, professional, or confidential information. You agree to treat such information with discretion and in accordance with applicable ethical and professional standards. You may not reprint, make public, or share any information from the platform without prior written authorization. 

9. Access, Suspension, and Termination 

Access to the Platforms may depend on your status or eligibility to access Platform content or features. Think:Kids may suspend, limit, or terminate your access to the Platforms at any time if you violate these Terms, no longer meet eligibility requirements, or if such action is necessary to protect the community or the integrity of the Platforms. 

10. Disclaimers 

The Platforms and all related materials are provided on an "as is" and "as available" basis. Think:Kids disclaims all warranties, express or implied, including but not limited to warranties of accuracy, reliability, non-infringement, merchantability, and fitness for a particular purpose. Think:Kids does not warrant that the Platforms will be uninterrupted, error-free, secure, or free from harmful components. 

11. Limitation of Liability 

To the fullest extent permitted by law, Think:Kids shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or related to your use of the Platforms, including but not limited to loss of data, profits, goodwill, or business interruption. Some jurisdictions do not allow certain limitations of liability; in such cases, these limitations may apply only to the extent permitted by law. 

12. Modifications to Terms 

Think:Kids may revise these Terms from time to time. Updated Terms will be posted with a new effective date. It is your responsibility to periodically review these Terms to stay informed of updates. Your continued use of the Platforms following any update constitutes acceptance of the revised Terms. 

13. Third-Party Links 

The Platforms may contain links to third-party websites or services. Think:Kids is not responsible for the content, policies, or practices of such third parties. Accessing third-party sites is at your own risk. 

14. Governing Law 

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws principles.
